Terms of Service

These Terms of Service ("Terms") govern your use of the Trak mobile application ("Trak" or "the Service"). By creating an account or using Trak on iOS or Android, you agree to these Terms and to the processing of your information as described in our Privacy Policy.

If you do not agree to these Terms, please discontinue use of the Service.

1. Who Can Use Trak

You may use Trak only if:

• You are at least 13 years old
• You have the legal authority to accept these Terms
• You are not prohibited from using the Service under the laws of your jurisdiction
• Your account has not previously been suspended or banned for violating our Terms

You must provide accurate and current information when creating your account, and you are responsible for maintaining the confidentiality of your login credentials.

2. Description of the Service

Trak is a personal and group productivity tool that helps users manage:

• Tasks
• Grocery lists
• Events and reminders
• Shared expenses
• Group communication ("vibes," comments, and notes)

Trak is designed for casual coordination among friends, families, roommates, and small groups. It provides informal records of tasks, activities, and shared expenses; these records are not legal, financial, or binding agreements.

You understand and agree that:

• Trak is provided "as is" and "as available"
• Some features may be improved, modified, or removed over time
• We may update the Service or restrict access to certain features without notice

3. Informal Records and Accuracy

Trak allows users to create and share entries within groups. These include tasks, events, and shared expenses.

You agree and understand that:

• Any shared information is informal and not legally enforceable
• Trak cannot guarantee the accuracy of information entered by users
• You are responsible for verifying the accuracy of shared data before relying on it
• Expense calculations, splits, and summaries are informational only and not professional financial advice

4. Acceptable Use

You agree to use Trak only for lawful and appropriate purposes.

You may not use Trak to:

• Harass, threaten, or harm others
• Post abusive, obscene, or hateful content
• Share content that violates privacy or publicity rights
• Upload illegal content, including anything related to criminal activity
• Impersonate others or misrepresent your identity
• Attempt to hack, damage, or disrupt the Service
• Use Trak for fraud, money laundering, or manipulative behavior
• Engage in spamming or unauthorized promotional activity

We reserve the right (but are not obligated) to investigate misuse and take appropriate action, including limiting functionality, removing content, or terminating accounts.

5. User-Generated Content

You are solely responsible for the content you create, upload, or share using Trak.

This includes:

• Task descriptions
• Event details
• Expense entries
• Notes, comments, and vibes
• Uploaded photos

Trak is not responsible for evaluating the accuracy or legality of user content.

We may remove or restrict content that:

• Violates these Terms
• Harms other users
• Appears illegal, abusive, or misleading
• Exposes Trak or users to potential liability

We are not required to monitor user content, but we may do so at our discretion.

6. Privacy and Security

Your use of Trak is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you agree to the processing of your information as outlined in the Privacy Policy.

You are responsible for:

• Protecting access to your device
• Preventing unauthorized use of your account
• Keeping your login credentials secure

If you suspect unauthorized activity, you must notify us promptly.

7. Subscription and Payments

Trak may offer premium features or subscription plans.

On iOS and Android:

• Purchases are processed through Apple In-App Purchases or Google Play Billing
• Pricing and terms will be shown before purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• Refunds, when available, must be requested through Apple or Google according to their policies

Trak does not store or process credit card information.

We may modify subscription pricing or benefits at any time, and changes will apply to future billing periods.

8. No Warranty

To the fullest extent permitted by law:

Trak is provided "as is" and "as available" without warranties of any kind.

We do not guarantee that:

• The Service will be error-free
• Content will always be accurate or reliable
• Features will remain available
• The Service will be uninterrupted
• Data will never be lost

You use Trak at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law:

• TrakApp LLC and its team will not be liable for any indirect, incidental, special, consequential, or exemplary damages.
• We are not liable for disputes between users, including disagreements related to tasks, events, shared expenses, or group interactions.
• Our total liability to you for any claim will not exceed the amount you paid (if any) for the Service in the last 12 months.

Some jurisdictions do not allow certain limitations; in those cases, some limitations may not apply to you.

10. Termination

You may stop using Trak at any time.

We may suspend or terminate your access if:

• You violate these Terms
• You misuse the Service
• Required by law
• We discontinue all or part of the Service

Upon termination, your rights to use Trak end immediately. You may request deletion of your account as described in our Privacy Policy.

11. Indemnification

You agree to indemnify and hold harmless TrakApp LLC and its employees, partners, and contractors from any claims, losses, damages, liabilities, legal fees, or expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your content
• Your interactions with other users

12. Modifications to These Terms

We may update these Terms from time to time. When we do, we will:

• Update the "Last Updated" date, and
• Notify you if the changes are significant

Continued use of Trak after modifications means you accept the updated Terms.

13. Severability

If any part of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in effect.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrakApp LLC regarding your use of the Service.
